So, if things turn really bad on Nov 5th and the SCOTUS looks like they'll try to overturn the election as they did in FL - can POTUS then legally, in colusion with his executive staff as we've been told by Roberts, remove traitorous Supreme Court Justices, save democracy, and let the peoples' votes be counted fairly?

I like your thinking, Garry. Would be worth a try since SCOTUS itself provided the incentive!

💯

This is a solid plan- hopefully Joe’s already talking to his council about it. It could be the gift that keeps on giving!!

No. Supreme Court justices can only be removed through the process of impeachment.

Expand full comment

Impeachment is the only legal means of removing a federal judge.

But presidents can do things that are illegal, per Justice Roberts and his pals.

Yeah, there’s that…

The US Supreme Court is an existential threat to the American way of life. It has immunized tyranny - something so-called "originalists" should know. John Roberts is dismantling our democracy, made a mockery of the rule of law, and is himself tyrannizing the people - young women, minorities - the most vulnerable. These are not the actions of a religious and righteous man - but someone masquerading as one. And unfortunately, he has fooled so many. This is al revealed in my interview with author and investigative journalist, David Daley, regarding his new book Antidemocratic: Inside the Far Right's 50-Year Plot to Control American Elections. Let us not forget the electoral college - the life raft for states rights.

What’s we have learned from all of the revelations about huge “favors” and loans and gifts to Justice Thomas is that the Supreme Court has reverted to the courts of old and legend where suitors came and paid for favors. There is simply no difference between what this court has normalized as as a symbiotic relationship between our billionaire oligarchy and their supremely courtly supplicants on this court. It’s a travesty and a national disgrace.

While Joyce is occupied with her chicks, she has left us a frightening article to read. In Michael Waldman’s words, he could live with a conservative Supreme Court, but what we have is a MAGA Court.

His description of Chief Justice Roberts’ role in this process makes me puke. Thomas and Alito—together with Kavanaugh—are baaaad boys, but Roberts is the worst of all.

He should have known better. Now I am deeply concerned about what this Stench Court might do, were the November 5th election closely contested.

Trump has trashed the Constitution and the Stench Court is destroying the constitutional checks and balances between the executive, the legislature, and the judiciary.

The Founding Fathers would weep.

Having read Rachel Maddow’s Prequel, which is all history and scant, benign editorial, mind you, I perceive Roberts’ intention to drive us towards a Fascist States of America as being indisputable. It is every fallen/craven global oligarch’s dream.

I try to shy away from guesswork, but when forces align, we must call a duck a duck. We must assume that we’re barely scratching the surface of the compensation for the MAGA six.

We must fight and support and volunteer and donate and vote like hell!

Justices should be on the court no longer than 12 years (3 presidential terms). Perhaps allow a vote to extend their term by an additional 4 years.

Expand full comment

Saw a suggestion once where terms were staggers so that each president in a 4-year term would be able to nominate/seat one SC Justice. That tied the popular vote to the appointment of Justices (EC notwithstanding).

It’s time to act like we are in the war we are in. Arrest those who are responsible for corruption in their elected and appointed offices (several of the SCOTUS Six lied in their rigged confirmation hearings; all have destroyed democracy already by allowing presidential immunity) and indict them for the overthrow they are so far successfully conducting without opposition, without arrest and with mostly punditry, memes and open letters.

Leonard Leo is at war. Mitch McConnell is at war. The SCOTUS Six are winning the ultimate war. The Washington Spectator has laid out the last phase of the overthrows long in the making: the election war plan.

Who will take aim at these enemies? These corrupt destroyers of democracy? The time for pontificating is nearly four years past. The highest criminals - the Kings Men - of Jan 6 roam the halls of congress free.

Once again I fault Merrick Garland - someone it turns out Obama should have never fought for to put on the Supreme court. Now as AG, instead of Garland focusing attention of what the FBI got wrong or didn’t investigate leading up to the SCOTUS confirmation hearings of Kavanaugh and others - he focused on the president’s son. Like Barr or not, he would never have done what Garland did in a million years. What we need is a tenacious AG, one that will use the laws on the books, to ensure these sedicious criminals, never do it again. If Kamala Harris wins, I believe she will do just that!

I wish the legal system was more responsive, but many of the laws have not kept up with the level and speed of corruption Trump has brought forth. And of course, Merrick Garland doddled along, if it were me, I would have fired him long ago.

Expand full comment

Unfortunately, the corruption is endemic in this Congress. People who experience Jan. 6 firsthand, ducking for cover, yet now they are covering for Trump. They are despicable, and are destroying democracy from the inside out - with the help of the US Supreme Court. To learn about how endemic the corruption is, watch my program with investigative journalist and author David Daley. It's an eye-opener to say the least. Maybe this has nothing to do with it, but I’m a Catholic, and so much of this is happening with Catholic Supreme Court Judges. I find it deeply troubling and unacceptable! I just don’t get it!

I do. I went to a Catholic grade school once upon a time. They are a weird and creepy bunch. The finally expelled me in 7th grade but not before I had raised Cain.

Hi! I have 12 years of Catholic education and I think their behavior is a betrayal of everything I learned and every citizen. We actually took Civics and learned how government is supposed to work. Perhaps there’s a lot of arrogance happening there. You are right though. Sometimes when I see a long line of Cardinals marching in for a big meeting, wearing their certain clothes, I think, “If I wasn’t a Catholic and didn’t understand it, I would assess this to be weird as all get out.” Thanks for your comment. It gave me a chuckle at the very least.

What can be done to stop this Supreme Court before it does more damage? It will stop Harris from enacting her agenda. It will destroy our democracy.

Ed, one idea I’ve seen mentioned is to expand the SC to twelve justice’s— one for each of the 12 federal district courts. To me it would be logical and not blatant “court parking” as some suggest. AND implement term limits & an enforceable ethics code.

Yup, but will have to be 13 to avoid ties.

Term limits and binding ethics rules will not stop the court from keeping on keeping on with the MAGA bent now. The only way is court expansion. Even the playing field. Give every president the same number of picks every term. Rotate the bench from among a larger corral of justices, much as the district courts do, so no one knows who will hear a given case. Congress should take back control of the docket. And Biden needs to speed up the judicial appointments at the district level to fix the broken 5th Circuit.

Expand full comment

Yes. We can keep lifetime appointments (yuck) but limit the time as a Supreme Court justice and rotate judges in and out.

We should be able to have a say-and a vote!!-on who stays or goes in the SCOTUS.Each and every ruling they decide, affects each and every one of us.We absolutely deserve a say in that.

This business of these Justices basically having no oversight from anyone or any entity,is absolute bullshit. This needs to stop! They need to be held accountable and we need a voice in how that is done.If they can decide our future, then we should have a voice and a vote in deciding theirs.

Immunity from the law should only be applied to kings. It brings up a host of serious problems that will need to be addressed if we want to maintain the democracy.

It is time for serious SCOTUS reform. Thanks to Joyce Vance for pointing me to this piece. And thanks to you for the work you are doing.

Since most, if not all, Justices on the Supreme Court have previously served as Federal judges why are they not bound by the oaths and commitment to ethics codes they swore to uphold? Is there some form of absolution, exorcism or other process by which they are relieved of these obligations?

I whole heartedly agree! Ever since the January 6th 2021 debacle at the Capitol Building I have been asking the one question! What is so damn supreme about the Supreme Court?
